Stephen W. Gieger

Stephen Gieger is a New Orleans native and has been practicing law since 2016. Stephen is admitted to practice before all Louisiana courts as well as the United States District Court for Eastern, Middle, and Western Districts of Louisiana and the United States Fifth Circuit Court of Appeals.

Stephen’s civil litigation practice is as varied as the many industries in which his clients conduct business including product design and manufacturing, medical devices, professional services, healthcare, amusement and water parks, construction, toxic tort, contractual disputes, retail, transportation, oil and gas, and insurance. Stephen routinely defends individuals, companies, and insurance carriers in cases involving catastrophic injury, wrongful death, malpractice, property damages, commercial disputes, and bad faith litigation.

Stephen represents his clients to whatever degree litigation is required, including all aspects of pre-trial, mediation, trial, and appellate practice. Stephen has taken numerous cases to trial and has obtained multiple defense verdicts for his clients.

Representative Cases

The following cases are representative of the types of cases regularly handled by Stephen:

• Overhead Door Corp., v. The Sewell Group, LLC et al., Jefferson Parish, Louisiana. Defended a general contractor and a material and labor supplier in a construction case against claims by a subcontractor for breach of contract, indemnity, and penalties under the Louisiana Private Works Act. The case was tried before a jury resulting in a unanimous defense verdict.

• Anthony J. Francis v. Michael Thomas Trucking, LLC et al., Vermillion Parish, Louisiana. Defended a trucking company and its driver in a personal injury lawsuit involving a motor vehicle accident. A jury returned a verdict of 80% liability allocated to the plaintiff, denied recovery of claimed future medical expenses and lost earnings, and awarded only a portion of the plaintiff’s claimed past medical expenses.

• Dino Vincent Tuminello v. Neveplast SRL, et al., Lafayette Parish, Louisiana. Defended an amusement park ride designer and manufacturer against claims brought by a patron under the Louisiana Products Liability Act. Successfully obtained summary judgment through the use of expert testimony.

• James Marshall v. Baja ConEagle, LLC, Richland Parish, Louisiana. Defended a cotton gin designer and manufacturer against claims brought by a worker whose arm was severed. Successfully argued on summary judgment that the successor company was not liable under the Louisiana Products Liability Act for defective design and construction and inadequate warnings.

• Mitchel Shannon Poole v. Furrion, LLC et al., Pointe Coupee Parish, Louisiana. Defended a claim for wrongful death made against the designer and manufacturer of recreational vehicle charging cables and outlets. On appeal, the Louisiana First Circuit reversed the district court’s ruling finding that the defendant client lacked sufficient contacts in the State of Louisiana to exercise jurisdiction over it.

• Ashland, LLC v. Grayling Industries, LLC et al., United States District Court, Western District of Louisiana. Defended a packaging designer and manufacturer against claims that the packaging liner was defective and caused a chemical exposure. Successfully excluded plaintiff’s expert under Daubert and leveraged a favorable settlement as a result.

• Michael Wagner v. Dr. Mark Noar, Mederi RF, LLC, United State District Court, Eastern District of Louisiana. Defended a physician and a medical device manufacturer against claims alleging complications from a procedure. The claims were dismissed on summary judgment on a finding that the device used in the procedure did not cause plaintiff’s condition and that the treatment met the standard of care.

• Deanna Ford Nora v. Kindred Healthcare, Inc., Orleans Parish, Louisiana. Defended Kindred Healthcare, Inc. against intentional tort claims brought by an employee of a behavioral health clinic. Successfully obtained summary judgment on a finding that the record evidence failed to establish an intentional tort and that the plaintiff’s recovery was limited to workers compensation benefits.

• Patricia Ice v. St. Tammany Parish Hospital, St. Tammany Parish, Louisiana. Defended a hospital against a patient’s claims alleging a failure to timely diagnose and treat an epidural hematoma. The claims were dismissed on summary judgment on a finding that the countervailing expert testimony demonstrated that the treatment met the standard of care.

• Greving Carbajal v. National Maintenance & Repair of Louisiana, LLC, Jefferson Parish, Louisiana. Defended a construction contractor against personal injury claims brought by a subcontractor’s employee. Successfully obtained a dismissal on summary judgment on a finding that the contractor qualified as a statutory employer.

• Timothy Spisak v. Siren Oil Services, et al., United States District Court, Western District of Louisiana. Defended an offshore oil and gas company against personal injury claims brought by a contractor’s employee. The claims were dismissed on summary judgment based on a successful contractual argument.

• Eduardo Garcia v. James Industrial Constructors, LLC, Calcasieu Parish, Louisiana. Defended industrial contractor against personal injury claims resulting from an alleged contaminant exposure. Successfully obtained a dismissal on summary judgment based on a finding that the expert testimony failed to establish medical causation.
