Janet H. Aschaffenburg

Of Counsel

Janet (“Jan”) Aschaffenburg was born in Memphis, Tennessee and grew up in New Orleans, Louisiana. Jan has been in the oil and gas arena for over twenty-five years, having started her career in the land department of Getty Oil Company, where she worked for several years before going to law school. Her land/legal experience includes offshore Gulf of Mexico and onshore Louisiana oil and gas title and transactional projects, but she has focused primarily on offshore Gulf of Mexico matters in recent years. Her practice areas include: oil and gas transactions, mineral title examination, regulatory matters relating to onshore and offshore mineral leasing, contracts, and real property acquisitions.

Representative Cases

During her career, Ms. Aschaffenburg has assisted in numerous acquisitions and divestitures of mineral properties and other assets, including: the divestiture and/or acquisition of thousands of outer continental shelf lease blocks with aggregate values in the billions of dollars, including review of and revisions to proposed transaction documents, drafting, filing and recordation of transfer forms and other related regulatory forms; title examination and rendering of opinions (for acquisition, exploratory and/or division order purposes) on outer continental shelf properties, including complex ownership of deepwater Gulf of Mexico leases; and assistance in the sale of extensive pipeline gathering systems covering onshore and offshore facilities and associated rights-of-way. Over the course of such transactions, she has conducted title due diligence, drafted due diligence reports, identified title defects, drafted title defect notices, and handled post-closing filings. Additionally, she has assisted clients with the drafting and negotiation of withdrawal agreements affecting jointly owned assets and Office of Natural Resources Revenue requests and Orders. She also regularly assists clients with ongoing Bureau of Ocean Energy Management and Bureau of Safety and Environmental Enforcement adjudication and regulatory matters and issues, including, without limitation, new company qualifications, qualification updates (name changes, mergers and business conversions), preparation of Designation of Operator forms, oil spill financial responsibility renewals and updates, pipeline filings, bonding and advice with regard to plugging, abandonment and decommissioning obligations.

Education

Ms. Aschaffenburg attended Louisiana State University in Baton Rouge and obtained a Bachelor of Science degree in 1979. She graduated from Tulane University School of Law in 1990.
